Digitalization of the public law control system as an instrument for ensuring Ukraine’s national security
Abstract
Purpose. The purpose of the study is to provide a scientific substantiation of the digitalization of the public-law control system as an instrument for ensuring Ukraine’s national security, to determine its legal nature, the main directions of its influence on the state’s control function, and the limits of the permissible use of digital tools in the sphere of public authority oversight.
Method. The study employs dialectical, systemic-structural, formal-legal, comparative-legal, and hermeneutic methods, as well as methods of legal modelling and scientific generalization. This methodological framework enabled a comprehensive analysis of the legal foundations of public-law control digitalization, European standards of electronic identification and data protection, and the role of digital technologies within the national security system.
Findings. The findings demonstrate that the digitalization of public-law control extends beyond the technical modernization of administrative procedures and fundamentally transforms the nature of state control activities. A multi-level structure of digitalized control is substantiated, encompassing normative-security, administrative-organizational, information-technological, and human-rights dimensions. The study identifies the role of electronic identification, digital registries, information-analytical platforms, and cybersecurity mechanisms in enhancing the effectiveness of control procedures.
Theoretical Implications. The research advances scientific approaches to understanding digitalized public-law control as an independent legal phenomenon that integrates elements of public administration, information law, cybersecurity, and national security law.
Practical Implications. The study formulates recommendations for improving the legal regulation of digital public-law control, particularly in the areas of interagency data exchange, personal data protection, cybersecurity resilience of state information systems, regulation of automated monitoring, and procedures for appealing digital decisions.
